DUIs and DUIDs
Significant changes to the DUI laws became effective January 1, 2014 in Colorado. If you have a blood alcohol content of .15 you will now be categorized as a PERSISTENT DRUNK DRIVER even if it's your first offense.
What is Drunk Driving? Driving Under the Influence of Alcohol and/or Drugs--BAC test of .08 is the per se threshold for driving with excessive alcohol content. §42-4-1301. If you test at .08 or greater, it will give rise to the permissible inference that you are under the influence of alcohol.§42-4-1301(6)(a)(III)
DMV LICENSE REVOCATION
If you took a breath test and the result was .08 or greater your license will be taken by the police and you will be issued a temporary driver's permit. If you took a blood test the results will be mailed to you.
You have just 7 days to request a hearing to contest the revocation of your driver's license. You need a knowledgeable attorney who can advocate your side and challenge the evidence being used against you at the DMV Express Consent Hearing.
State Criminal Court
You need an advocate to attack the evidence and the experts the prosecutors are relying on to file DUI charges in criminal court. The court has 10 days to report a conviction to the DMV.
